Vande Mataram: History, Freedom Struggle & Legal Framework

2025–26 is particularly important for Vande Mataram, as India is commemorating 150 years of the National Song. The Government of India launched a year-long commemoration from 7 November 2025 to 7 November 2026.

1. What is Vande Mataram?

English:
Vande Mataram means “I bow to thee, Mother” or “Mother, I bow to you.” It was composed by Bankim Chandra Chattopadhyay (Bankim Chandra Chatterjee) and became one of the most powerful cultural and political symbols of India's freedom struggle.

The song was first published in the literary journal Bangadarshan on 7 November 1875, according to a PIB backgrounder.

2. Historical Background

1875 – Composition

English:
Vande Mataram was composed by Bankim Chandra Chattopadhyay in the 19th century. Government sources identify 7 November 1875 as the date associated with its first publication in Bangadarshan.

1882 – Anandamath

The song was subsequently incorporated into Bankim Chandra's famous novel Anandamath, published in 1882.

3. Vande Mataram and the Freedom Movement

Vande Mataram gradually transformed from a literary composition into a nationalist slogan and rallying cry.

1896 – Rabindranath Tagore

One of the most important milestones came in 1896, when Rabindranath Tagore sang Vande Mataram at the Indian National Congress session in Calcutta (Kolkata).

1905 – Partition of Bengal

The song acquired enormous political significance during the Swadeshi Movement following the Partition of Bengal in 1905.

The expression “Vande Mataram” was used as a political slogan on 7 August 1905, making it an important symbol of resistance to colonial rule.

4. Why did Vande Mataram become so important?

English:

The song combined three powerful ideas:

  1. Love for the motherland
  2. National unity
  3. Resistance against colonial rule

It was sung at political meetings, processions and gatherings and became closely associated with India's freedom movement. Government sources describe it as a song that inspired generations of freedom fighters and nation-builders.

5. Vande Mataram vs Jana Gana Mana

Point Vande Mataram Jana Gana Mana
Composer Bankim Chandra Chattopadhyay Rabindranath Tagore
Historical role Major role in freedom struggle National Anthem of independent India
Constitutional position Not expressly mentioned in Constitution National Anthem by constitutional practice/official adoption
1950 decision Equal honour/status with Jana Gana Mana Adopted as National Anthem

Important Exam Point

On 24 January 1950, Constituent Assembly President Dr. Rajendra Prasad made the historic statement that Jana Gana Mana would be the National Anthem, while Vande Mataram, which had played a historic role in India's freedom struggle, would be honoured equally with Jana Gana Mana and have equal status with it.

Prelims Trap:
Vande Mataram = National Song
Jana Gana Mana = National Anthem

6. Legal & Constitutional Framework

This is one of the most important aspects for HAS/Allied and UPSC Polity.

A. Is Vande Mataram mentioned in the Constitution?

English:
The Constitution of India does not expressly designate Vande Mataram as the National Song through a specific constitutional article.

Its official national status flows primarily from the decision/statement of the Constituent Assembly on 24 January 1950.

7. Is there a law making it compulsory to sing Vande Mataram?

English:
There is no general constitutional provision making every citizen legally bound to sing Vande Mataram.

The legal framework concerning national symbols and patriotic expressions must also be understood in light of fundamental rights, particularly freedom of speech and expression and freedom of conscience.

8. Fundamental Duties and National Symbols

Article 51A(a) of the Constitution says that it is the duty of every citizen:

“to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem.”

Important distinction

Vande Mataram is not expressly named in Article 51A(a).

Article 51A(a) → National Flag + National Anthem

Vande Mataram → National Song, with equal status/honour as recorded by the Constituent Assembly.

9. Freedom of Speech, Expression and Conscience

The legal debate around patriotic songs must be understood within the framework of Articles 19 and 25 of the Constitution.

Article 19(1)(a)

Provides citizens with the freedom of speech and expression, subject to reasonable restrictions under Article 19(2).

Article 25

Protects freedom of conscience and free profession, practice and propagation of religion, subject to constitutional limitations.

Exam perspective:
The existence of a national song does not automatically mean that the State can impose an unrestricted compulsion on every individual to sing it.

10. Court-related Legal Principle

A useful constitutional principle from Indian jurisprudence is that respect and compelled participation are not always the same thing.

The Supreme Court's reasoning in cases concerning national symbols and patriotic observances has emphasized the importance of balancing national honour with constitutional freedoms.

For examination purposes, remember:

Respect ≠ necessarily forced vocal participation.

11. 150 Years of Vande Mataram – Current Affairs 2025–26
